2018 Updated Weight Loss Disclaimers

In 2018, the Company updated our weight loss disclaimers based on the findings of our latest clinical study. Please find additional information concerning these updated weight loss disclaimers below: 

Disclaimer Overview

When only weight loss is mentioned, with no time frame, choose one of these following disclaimers:

  • Average weight loss on the Optimal Weight 5 & 1 Plan® is 12 pounds. 
  • Average weight loss on the Optimal Weight 5 & 1 Plan® is 12 pounds. Average fat loss is 10 pounds.
  • In a clinical study, the group on the Optimal Weight 5 & 1 Plan® lost 10x more weight than the self-directed group. Average weight loss on the Optimal Weight 5 & 1 Plan is 12 pounds.

When weight loss is mentioned, along with a time frame, use only the following disclaimer:

  • Average weight loss on the Optimal Weight 5 & 1 Plan® is 12 pounds. Clients are in weight loss, on average, for 12 weeks.

Disclaimer Example 1:

Susan lost 50 pounds.*

Followed by the disclaimer:

*Average weight loss on the Optimal Weight 5 & 1 Plan® is 12 pounds.


Disclaimer Example 2: 

Susan lost 50 pounds*

Followed by the disclaimer:

*Average weight loss on the Optimal Weight 5 & 1 Plan® is 12 pounds. Average fat loss is 10 pounds.


Disclaimer Example 3:

Susan lost 50 pounds.*

Followed by the disclaimer:

Should I replace existing disclaimers with these new disclaimers on my Facebook page?

Yes, please use these new disclaimers in all materials posted on/after July 26, 2018, and anything that’s produced moving forward. Adjustments to materials must be made in 30 days (by August 26, 2018). All posts on social media must be updated with these new disclaimers (or deleted) going back 30 days to June 26, 2018. Moving forward, our old disclaimer (“Average weight loss for Clients on the Optimal Weight 5&1 Plan® with support is 20 pounds. Clients are in weight loss, on average 12 weeks.”) may no longer be used. 


When do I need to make these updates?

Please make any and all updates by Sunday, August 26, 2018. Please note that we will be changing all weight loss disclaimers on our corporate site, social media pages, graphics, etc. in the same phased approach, and by the same deadline of Sunday, August 26, 2018.  Please update any materials or tools you use, including your social media posts, back to June 26, 2018, by adding one of the new disclaimers or by simply deleting those older posts.


Can I combine the disclaimers?

No, the two disclaimers should not be combined, they must be used separately and as explained above at all times.


Why did the number in the disclaimer go from 20 to 12?

The findings from our study are based on the average weight loss witnessed amongst those participants. Additionally, this study yielded additional, positive findings for the OPTAVIA group to use in some of the weight loss disclaimers.
